De Novo Privacy Policy

  1. Collected Information
    1. Behind the Gavel, LLC, (hereinafter “BTG”) will collect the following information from each De Novo user:
      1. First name
      2. Last name
      3. Email address
    2. BTG will collect and store a last-in-time log-in date for each individual user
      1. Once a user logs in, their last-in-time date will be stored until their next log-in, which will replace its predecessor, and so-on and so-forth, in theoretical perpetuity, until a contractual obligation has expired
      2. BTG will not store, for any period of time, log-in history data for each individual user; BTG will only store the last-in-time log-in
      3. BTG will not store any other data related to/stemming from the log-in, use, or non-use of De Novo
  2. Optional Collected Information
    1. BTG will give De Novo users the option to provide their phone number and their respective organization
      1. Phone numbers and organizations are NOT required to access De Novo and will only be collected (if provided) at the user’s discretion, to be used by BTG for the following purposes:
        1. Customer service
        2. Troubleshooting
        3. Surveys related to use, service items, and/or ways De Novo can improve
          1. Such information WILL NOT be used for any purpose related to sales and/or marketing
  3. Dissemination of Collected Information
    1. BTG will not furnish, provide, sell, or distribute any collected information to any third party, outside the scope of a contractual obligation with BTG, at any time, for any purpose, whatsoever, without a court order
  4. Storage Term
    1. BTG will store collected information for exactly two (2) years after the expiration of BTG’s contractual obligation(s) to any user or class of users
  5. Security
    1. BTG is strictly adhering to the guidelines set forth by the Legal Cloud Computing Association’s security standards as they apply to De Novo

    3. In the event of a security breach, BTG will notify all users that impacted information may be available to unknown/hostile third parties. Additionally, BTG will notify users that whatever data they have access to and any data that they’ve created on De Novo may be accessible to third parties by virtue of their access to/knowledge of the aforementioned information.
  6. Data Privacy
    1. BTG will limit access to any data stored on De Novo to only those who are legally obligated/permitted to access such data
    2. Any data provided to BTG by users will only be accessible by those who are legally obligated/permitted to access such data
  7. Usernames and Passwords
    1. De Novo users are responsible for maintaining the confidentiality of their usernames and passwords
    2. Users are responsible for all activities that occur by/through their use of De Novo and agree to notify BTG immediately of any unauthorized account use
    3. BTG is in no way responsible for any loss that users may incur as a result of any unauthorized use and/or access by an unauthorized third party
  8. Modification
    1. BTG may modify the terms of this Policy, including but not limited to content and the term(s) granted to users, at its discretion
    2. BTG will provide notice of any changes and/or modification to this Policy by providing users with written notice within 30 days of any change and/or modification
    3. Users should, at their discretion, check for updates to this Policy on a regular basis
  9. Communication Preferences
    1. If, at any point while using De Novo, a user does not wish to hear from/be contacted by BTG, please contact BTG and BTG will cease any/all present/future attempts to make communicate with said user
  10. Privacy Dispute Resolution
    1. Parties will attempt to resolve disputes out of or relating to this Policy through civil negotiation among and/or between the parties. If the matter is not resolved by negotiation, the parties will agree to Alternative Dispute Resolution in accordance with any statutory rules of mediation in the State of Washington
    2. If mediation does not successfully resolve the dispute, alternative form of resolution may be sought in accordance with any other rights and remedies afforded by law in the state of Washington
    3. Force Majeure
      1. If performance of this Policy or any obligation under this Policy are prevented, restricted, or interfered with by causes beyond either party’s reasonable control, and if the party unable to carry out its obligations gives the other party prompt written notice of such event(s), then the obligations of the party invoking this provision shall be suspended to the extent necessary by such event
